What do state unemployment agencies look for?

When state agencies rule on unemployment claims they generally expect employers to practice prudent business policies. The following is a description of what States consider when making determinations:

The employer needs to show good personnel policies.

  • Reasonable work rules.
  • Employee handbooks and/or posted rules.

The employee needs to understand the requirements of his/her job.

  • Give a full job description during orientation.
  • Review the employee's performance continually.

The employee should be given time to meet your standards.

  • Explain what needs to be improved.
  • Explain what will happen if the pattern is not corrected.

The employer must apply the policies uniformly.

  • Disciplinary warnings must be given in a consistent pattern.
  • A discharge must meet the requirements stated in your policy.
