Important Trust Dates to Remember

Trust Reserve Forms due November 1, 2015:

You annual reallocation of your Trust reserve is due November 1, 2016. This form is necessary to reallocate your reserve balance and obtain the greatest savings for your organization. If you have any questions or concerns about this form, your reallocation or reserve balance please contact Staff Name at fname@501c.com or call 800-123-4567.

Reserve Deposits due January 15, 2017:

All participants of 501(c) Agencies Trust will receive by U.S. Mail their recommended reserve contribution notice in the next 60 days. Please review this recommendation carefully. Reminder, this is just a recommendation. If you would like to discuss the deposit recommendation or your reserve balance please contact Staff Name at fname@501c.com or call 800-123-4567.

 


Trust Offices Closed for Thanksgiving

FLSA Overtime Rule Set to Update December 1, 2016

The U.S. Department of Labor (DOL) released its long awaited changes to the nation’s overtime rules. It is estimated that the changes will extend overtime pay protections to over 4 million workers next year. The rule change was requested in 2014 by President Barack Obama. Obama directed the DOL to update the regulations defining which white collar workers are protected by the Fair Labor Standards Act’s minimum wage and overtime standards. The main goal of the directive was to look for ways to modernize and simplify overtime regulations while ensuring that the FLSA’s intended overtime protections are fully implemented.

Key provisions of the new rules

The new DOL overtime rules focuses primarily on updating the salary and compensation levels needed for executive, administrative and professional workers to be exempt. Specifically, the new rules:

  1. Sets the standard salary level at the 40th percentile of earnings of full-time salaried workers in the lowest-wage Census Region, currently the South ($913 per week; $47,476 annually for a full-year worker);
  2. Sets the total annual compensation requirement for highly compensated employees (HCE) subject to a minimal duties test to the annual equivalent of the 90th percentile of full-time salaried workers nationally ($134,004); and
  3. Establishes a mechanism for automatically updating the salary and compensation levels every three years to maintain the levels at the above percentiles and to ensure that they continue to provide useful and effective tests for exemption.

Additionally, the the new rules amend the salary basis test to allow employers to use non-discretionary bonuses and incentive payments (including commissions) to satisfy up to 10 percent of the new standard salary level.
